But has anyone answered the question? Is he liable for the taxes? And as far as I'm concerned, the mistake was the Cub's organizatin, not the recipient of the errant cash. I would think he could keep it...tax free. I believe if you receive anything in the mail that you don't order, you can keep it without payment.

In general, windfalls are taxable income. If you get a mistaken payment and try to return it, and you take no steps to keep the mistaken payment, you should not incur taxable income. Oddly, Mr. Guthrie might be moving payments into the "taxable income" category by trying to keep it.
If the Tribune Company mistakenly sends me money, it doesn't become "my" money, any more than a state trooper's gun would become "my" gun if he absent-mindedly left it on my shooting bench (to use two unlikely examples).
